Pierre de Vos explains the constitutional position of freedom of expression in South Africa and the role of the press as a counterveiling power in a “dominant party democracy”. He thinks that the Bill will not pass in its current form, that the constitutional court is a strong and independent power, that there are important forces within the ANC who understand the importance of a strong and independent press - for the good of the ANC’s legitimacy as much as anything else.
